Information presented on the City of Markham website explains that the purpose of an egress window is to prevent a delay in the evacuation of occupants from a house. In order to be designated a proper escape window, at least one window on the floor must have an opening area that is at least 0.35m2 (or 3.8 square feet.) with no height or width dimension of less than 380mm (15 inches). In addition, the window must be openable from the inside without any special tools or knowledge. In most cases, egress windows open into a well, which is why the window well should have a clearance of not less than 550mm (22 inches). Moreover, if the window happens to open into the well, it should not reduce the opening in a way that will prevent emergency evacuation.

An egress window in a secondary living space will allow the resident to leave in the event of a fire or other emergency. Hamilton bylaws require that renovations and modifications to a property be made by first obtaining a permit from the city. The permit should have a drawing of the proposed modification and its impact on the structure.
Currently, the city of Markham doesn’t allow the creation of legal secondary units but there are exceptions for those that presently own one. If your secondary unit was built before November 16, 1995, it can qualify for legal status provided you register it with the city. Your secondary unit must be registered, otherwise, you can face a fine of up to $25,000.
If you own a home that has a second unit that was built before November 16, 1995, you can register it by first having it inspected by Markham Fire & Emergency services. Once the unit has been inspected you can register it with the city by completing the appropriate form. The costs involved are – $300 for the initial inspection and $150 to register the unit.
